NV Nexus - General Requirements:

The word "nexus" means a link or connection. If you are determined to have nexus to a U.S. state then you are subject to that state's sales and use tax rules and must collect and remit sales tax to the state. This is known as a "filing obligation."

Each state has a different definition of nexus. However, if the answer to any of the following questions is yes, it is likely that a company has nexus as legally defined in most U.S. States.

Does the company own property in the state? Does the company have employees living in the state? Does the company regularly send employees in the state to perform services? Does the company have an agent acting on behalf of the company in the state?

Nevada imposes nexus on businesses either maintaining a business location, making sales of tangible personal property for storage, use, or other consumption, or having employees or agents in the state; soliciting sales in the state by means of telecommunications or television using toll-free numbers; soliciting sales by mail or fax if solicitations are substantial; benefiting from banking, financing, and debt collection activities in Nevada.

NV Local Tax - Do Localities Impose Tax?

Yes, Nevada imposes local sales tax.

NV Resale Certificate Renewal Agreements:

In Nevada, for a purchase of tangible personal property or services to be nontaxable as a result of intent to resell, the purchaser must provide the seller with a resale certificate. The resale certificate transfers liability of sales and use tax to the purchaser.

NV Resale Certificate Renewal Periods

No expiration period is specified in regards to resale certificates, although, blanket certificates are stated as valid until revoked in writing.

NV Statute of Limitations

Later of three years from: the date the return was filed or the last day of the calendar month following the tax period. Eight years when no return was filed. There is no limitation in the case of fraud.
